The following terms and conditions form the Agreement between you and WeSave, Inc. ("WeSave").

Reservation of Rights: WeSave reserves the right to modify any portion of this Agreement, in whole or in part, at any time. Notification of modifications to the Agreement will be posted on www.wesave.com. Participation in the WeSave program after such notice demonstrates your willingness to be bound by such modifications.

Intellectual property: The WeSave program is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions and other copyright laws. WeSave names, logos and trademarks may not be used by you in any manner without the prior written consent of WeSave.

Limitation of liability: In no event shall WeSave be liable for any direct, indirect, special, consequential or other damages arising out of the use of the WeSave program. This includes without limitation lost profits, business interruption, damage to equipment, computer programs, or information systems, or the loss of any information or data. The maximum liability collectively of WeSave shall not exceed twenty dollars for any damages of any nature, including gross negligence, arising in contract, tort or otherwise.


Terms and Conditions - Giveaways and Promotions

Unless otherwise noted, these Terms and Conditions (official rules) govern WeSave giveaways and/or promotions and the administration thereof. By accessing the web site (www.wesave.com) and/or by participating in WeSave giveaways and/or promotions, you consent to these official Rules and Regulations.

All giveaways and/or promotions on wesave.com are administered by WeSave, Inc. (“WeSave”). All decisions of WeSave are final and binding in all matters as they relate to giveaways and/or promotions.

  • Giveaways and/or promotions are not open to WeSave employees or members of their immediate family.
  • Giveaways and/or promotions are open to public employees who activate their WeSave membership cards prior to the published deadlines for specific giveaways and/or promotions.
  • No purchase necessary to enter or receive a prize.
  • All federal, state and local laws and regulations apply.
  • Drawings: Using a computerized random number generator, WeSave Winners are randomly selected from a pool of all WeSave cardholders who “registered” for a particular giveaway and/or promotion. Winners of WeSave’s “hourly giveaways” are randomly selected based on membership card activation; no other registration is required. The odds of winning a prize depend upon the number of eligible WeSave cardholders at the time of the selection of potential winners. The number of times a person can win in any given period of time will be decided by WeSave on a case-by-case basis and/or published in official instructions for specific giveaways and/or promotions.
  • Winners will be contacted by the email address and/or phone number provided at activation and/or registration. If the winner’s email address and/or phone number is no longer valid at the time of award, the prize may be forfeited. Using whatever contact information the winner has provided to WeSave, every attempt will be made to contact the winner. Winners may be contacted at their place of work or through their employer.
  • Claiming Prizes/Releases: Eligibility, age, proof of employment and claim by potential prize winners are subject to verification and signed release in acknowledgement, understanding and agreement of WeSave’s Rules and Regulations (Terms and Conditions). If, at the time of contest entry, the selected entrant has not obtained the age of 18 years old, a parent or guardian’s signature may be required on the above mentioned declaration and release form or, based upon applicable law, the parent or guardian may be required to claim the prize.
  • Winners agree to allow WeSave to post their name and/or likeness, agency and prize on wesave.com and subsequent marketing materials without compensation or notification. Winners who supply WeSave with quotes and photos also agree to permit WeSave to post on wesave.com, and subsequent marketing materials without compensation to the Winner or further notification.
  • The winner agrees to accept the prize as offered and releases WeSave, Inc., – owners, agents, officers, employees, successors or assigns, (“WeSave”) from any and all liability of any kind arising out of the entrant’s participation in this contest, receipt and use of the prize and the publication of the winner’s name and likeness for marketing purposes.
  • All taxes, fees, or other charges, if any, are the sole responsibility of the winner. By awarding the prize, WeSave is relieved and discharged from any liability or damage due in whole or in part to the award, acceptance, possession, use or misuse of any prize or from participation in this contest.
  • In the event of any portion of a WeSave giveaway and/or promotion is comprised by a computer virus, technical bug, non-authorized human intervention, hackers or other causes beyond the control of WeSave and its contractors, which is in the sole opinion of WeSave impairs the administration, security, fairness or proper play of the contest, WeSave reserves the right, at its sole discretion, to suspend or terminate all or part of the contest. WeSave is not responsible for any entry that is generated by computer hardware or software malfunction, error or failure, or tamper with or subject to any non-authorized human intervention. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIAMATE OPERATION OF WeSave’s GIVEAWAYS AND/OR PROMOTIONS IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WeSave RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
  • Except where prohibited, entrant agrees that any and all disputes, claim and causes of action arising out of, or connected with, any contest or prize awarded shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation, forcibility of official contest rules, entrant rights and obligations, for the rights and obligations of WeSave in connection with the contest, shall be governed by and construed in accordance with, the laws of the State of West Virginia. Any disputes arising there from, shall be decided in the courts in the State of West Virginia.
